Privacy Policy

At OnlyCuba (“we”, “the platform”) we process your personal data responsibly. This Privacy Policy explains what information we collect, for what purpose, for how long, and what rights you can exercise. It applies to visitors, fans, and creators who access OnlyCuba, including anyone who confirms they are 18 or older on the age-verification screen.

By confirming your age with “YES, I AM OF LEGAL AGE”, registering, or using OnlyCuba, you accept the practices described in this policy and in our Terms and Conditions. If you do not agree, you must not use the service.

OnlyCuba is an adult-content site (+18). We do not knowingly collect data from minors. If we detect that a user does not meet the minimum age, we will delete or block the account and associated data as quickly as possible.

1. Data controller

2. Data we collect

Depending on how you use the platform, we may process the following categories of data:

2.1. Data you provide directly

  • Registration and account: email address, username, password (stored encrypted), role (fan or creator), profile preferences, and settings.
  • Public profile: biography, social-media links, profile and cover photos, welcome message, and any other fields you choose to complete.
  • Identity verification (creators): legal name, document number, phone, address, photo of an official identity document and a selfie holding the document next to a handwritten note with “OnlyCuba” and the date of the day; results of administrative review (approved/rejected).
  • Content: posts, stories, messages, comments, media files, and associated metadata.
  • Payments and payouts: transaction history, amounts, payment identifiers, tax or banking details needed for creator settlements (we do not store full credit-card numbers).
  • Support and reports: information you include when you contact us or report content or conduct.

2.2. Data generated by your use

  • Interactions: subscriptions, follows, likes, saved items, PPV purchases, tips, and other actions on the platform.
  • Messaging: chat content and metadata (date, recipients, delivery status) when you use communication features.
  • Preferences and security: block lists, notification settings, geoblocking applied by creators, and sign-in records.
  • Age confirmation: session cookie age_gate (and an equivalent value in sessionStorage) indicating that you tapped “YES, I AM OF LEGAL AGE”. This cookie does not have a long expiry: it is deleted when you close the browser. We do not store your date of birth merely because you passed the age gate.

2.3. Technical and device data

  • IP address, approximate country or region derived from the IP, device type, operating system, browser, language, and technical identifiers.
  • Server logs, timestamps, URLs visited within OnlyCuba, and diagnostic data for security and performance.
  • Information collected through cookies and similar technologies (see section 8).

2.4. Sensitive data and adult content

Because OnlyCuba is an adult sexual-content platform, certain data may reveal your sex life, preferences, or consumption of explicit content (for example, which creators you follow, which posts you purchase, or what material you view). We process this information with enhanced security measures and only for the purposes described in this policy, on the basis of your explicit consent when you register and use the service, and when it is necessary to perform the contract with you.

3. Purposes and legal bases of processing

We use your data to:

  • Provide the service: create and manage your account, display content, process subscriptions and payments, enable messaging and creator features. Basis: performance of the contract.
  • Verify age and identity: confirm that you meet the +18 requirements and, for creators, complete KYC before publishing or getting paid. Basis: legal obligation, legitimate interest in protecting minors, and consent.
  • Security and abuse prevention: detect fraud, spam, impersonation, illegal content (especially material involving minors), and violations of our Terms. Basis: legitimate interest and legal obligation.
  • Moderation and compliance: investigate reports, respond to competent authorities, and comply with adult-content, intellectual-property, and payments rules. Basis: legal obligation and legitimate interest.
  • Communications: send you account notices, payment confirmations, security alerts and, with your consent when the law requires it, promotional communications. Basis: contract, legitimate interest, or consent.
  • Product improvement: analyze aggregated or pseudonymized use to fix errors and develop features. Basis: legitimate interest.
  • Geoblocking: apply territorial restrictions chosen by creators or required by regulation. Basis: contract and legitimate interest.

4. Who we share your data with

We do not sell your personal data. We may disclose it only in the following cases:

  • Service providers: hosting, storage, payment processing, identity verification (KYC), email delivery, technical analytics, and security tools, under contracts that require confidentiality and limited use.
  • Creators and other users: your public-profile information, your visible interactions (for example, comments or public tips), and content you share in messages or posts, according to privacy settings and the features you use.
  • Legal obligation: judicial or administrative authorities, when there is a valid request or it is necessary to protect rights, safety, or the integrity of minors.
  • Corporate transactions: in the event of a merger, acquisition, or transfer of assets, with adequate safeguards for the recipient.

Card payments are processed by certified third parties (for example, in accordance with PCI-DSS). OnlyCuba receives payment confirmations and transaction identifiers, not your full card details.

5. International transfers

Your data may be hosted or processed on servers located outside your country of residence. Where the law requires it, we adopt appropriate safeguards (such as standard contractual clauses or adequacy decisions) to protect your information in those transfers.

6. Retention period

  • Active account: we keep your data while you maintain the account and it is necessary to provide the service.
  • After closure: we may retain certain data for additional periods to meet legal obligations, resolve disputes, prevent fraud, or enforce our agreements.
  • KYC verification: creator identity records are kept for the time required by adult-content rules, anti-money-laundering rules, and our payment providers’ requirements (which may be several years).
  • Transaction records: kept according to applicable accounting and tax obligations.
  • Security logs: generally for a limited period, unless they must be preserved for an investigation.
  • Age-confirmation cookie: session cookie (deleted when you close the browser).

After the applicable periods, we securely delete or anonymize the data, unless it must be retained by legal requirement.

7. Security

We apply reasonable technical and organizational measures to protect your data against unauthorized access, loss, alteration, or disclosure, including encryption in transit (HTTPS), access controls, environment segregation, and review of critical providers (payments and KYC).

No system is completely infallible. If you detect a vulnerability or suspect unauthorized access to your account, contact soporteonlycuba@gmail.com immediately and change your password.

8. Cookies and similar technologies

We use cookies and session storage to:

  • Remember that you confirmed you are 18 or older (session cookie age_gate, without a long max-age: it is deleted when you close the browser).
  • Keep you signed in securely (refresh_token in an httpOnly cookie; the access token and session metadata are used on the client to call the API).
  • Store interface preferences (for example, light/dark theme in localStorage).
  • Measure performance and detect abuse in aggregate.

You can configure your browser to reject cookies; in that case you may not be able to complete age confirmation, sign in, or use some features. The +18 access cookie is set when you tap “YES, I AM OF LEGAL AGE”.

9. Your rights

Depending on the law applicable in your jurisdiction, you may have the right to:

  • Access: request a copy of the personal data we process about you.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure: ask for deletion of your data when it is no longer needed or you withdraw consent, except where there is a legal retention obligation (for example, KYC or tax records).
  • Restriction or objection: restrict or object to certain processing based on legitimate interest.
  • Portability: receive your data in a structured format, where technically feasible.
  • Withdraw consent: at any time, without affecting the lawfulness of prior processing.

To exercise these rights, write to soporteonlycuba@gmail.com stating your username and the right you wish to exercise. We may request additional information to verify your identity before responding. We will reply within a reasonable period under applicable law.

You can also update much of your information from your account settings or request account deletion, subject to the legal retentions mentioned.

10. Privacy of minors

OnlyCuba is directed exclusively at persons 18 or older. We do not knowingly collect personal data from minors. If a parent, guardian, or authority informs us that a minor has provided data, we will take steps to delete the account and associated information with the greatest urgency. Reports related to minors may be sent to soporteonlycuba@gmail.com.

11. Links and third-party services

Creators may include links to external sites (social networks, personal pages, etc.). OnlyCuba does not control the privacy practices of those sites. We recommend reading their policies before providing them personal data.

12. Changes to this policy

We may update this Privacy Policy to reflect legal, technical, or operational changes. We will publish the current version at this URL with the update date. If changes are significant, we will notify you by email or through a visible notice on the platform before they take effect, when the law requires it.
