18 U.S.C. §2257 Compliance

This page constitutes OnlyCuba’s public compliance statement regarding 18 U.S.C. §2257 and its implementing regulations (28 C.F.R. Part 75) concerning visual depictions of actual sexually explicit conduct available through the platform.

1. Records Custodian

The designated Records Custodian is:

The records required under 18 U.S.C. §2257 are maintained at the following address:

2. Age Verification and Identity Verification

OnlyCuba requires all Creators to be at least 18 years of age.

Before a Creator is authorized to publish content, the platform requires the completion of a mandatory identity verification process.

All Creators must submit a valid government-issued identification document.

OnlyCuba conducts a manual review of all submitted documentation to verify:

  • The Creator’s identity.
  • The Creator’s date of birth.
  • The authenticity of the submitted documents.
  • Compliance with the platform’s verification requirements.

Creator accounts remain inactive until the verification process has been completed and approved.

3. Recordkeeping Requirements

OnlyCuba requires all Creators who publish sexually explicit content to maintain all records required by 18 U.S.C. §2257 and 28 C.F.R. Part 75.

These records include, but are not limited to:

  • Government-issued identification documents.
  • Age verification records.
  • Documentation demonstrating that all individuals appearing in the content are at least 18 years of age.
  • Documentation establishing the identity of all individuals appearing in the content.
  • Documentation demonstrating the consent of all participants appearing in the content.

OnlyCuba may retain records necessary to comply with applicable legal, regulatory and contractual obligations.

4. Third-Party Content

OnlyCuba operates as a technology platform that allows independent Creators to publish and monetize their content.

OnlyCuba does not produce, direct or participate in the creation of content published by independent Creators.

However, the platform requires all Creators to complete the identity verification process and comply with all applicable legal requirements before publishing content.

5. Prohibited Content

OnlyCuba maintains a zero-tolerance policy regarding:

  • Content involving minors.
  • Non-consensual content.
  • Human trafficking.
  • Sexual exploitation.
  • Illegal content.
  • Content that violates the requirements established by applicable laws, Visa, Mastercard or payment processors.

Any content that violates these policies will be removed immediately.

Accounts associated with prohibited content may be suspended or permanently terminated.

6. Content Moderation

OnlyCuba reserves the right to review, restrict, remove or disable any content that violates the platform’s policies.

The platform may also investigate any activity that appears to violate applicable laws or internal policies.

OnlyCuba may request additional information from Creators whenever necessary to verify compliance.

7. Inspection Requests and Formal Inquiries

Inspection requests and formal inquiries related to 18 U.S.C. §2257 must be directed to the designated Records Custodian through the official support channel.
